Choosing to hire is certainly the more inclusive route, but it carries with it a host of legal obligations. While the obligations may be fewer if the label "independent contractor" is chosen instead, the labels are less important than the actuality. In other words, what your company may call an "independent contractor" may be the government's idea of an employee.
